Kaynak olarak esasta akl\u0131 kulanmakla beraber vahye dayanmas\u0131, konu itibariyle insanlar\u0131n cinsel hayattaki tercihlerine de\u011fin kurallar koymas\u0131, ama\u00e7 olarak insan\u0131n d\u00fcnyada mutlu olmas\u0131n\u0131n yan\u0131nda \u00f6l\u00fcm \u00f6tesi (ahiret) mutlulu\u011funu da esas almas\u0131 nedeniyle di\u011fer sek\u00fcler hukuk sistemlerinden temelde ayr\u0131l\u0131r.<\/p>\n<p>F\u0131kh\u0131n temel kayna\u011f\u0131 olan Kur\u2019an, mutlak hakimin bizatihi Allah oldu\u011funu1, k\u0131yamet g\u00fcn\u00fcndeki kurulacak olan mahkemede onun h\u00fck\u00fcm verece\u011fini ifade ederek,2 \u0130nsanlar\u0131n Kur\u2019an h\u00fck\u00fcmleriyle h\u00fckmetmelerini ister,3 h\u00fckmetmeyenleri ise \u00e7e\u015fitli vas\u0131flarda niteleyerek k\u0131nar.4 Peygamberi m\u00fcjdeleyici ve uyar\u0131c\u0131 olarak vasfederek,5 s\u00f6ylediklerinin bo\u015f \u015feyler olmay\u0131p, vahiy ve ilham eseri oldu\u011funu ifade ederek,6 ona uyulmas\u0131n\u0131 kimi yerde \u00f6\u011f\u00fctler,7 kimi yerde ise emreder.8 Allah\u2019\u0131n ve Res\u00fbl\u00fc\u2019n\u00fcn buyruklar\u0131n\u0131 yerine getirme hususunda titiz davrananlar\u0131 Allah kat\u0131nda ger\u00e7ek ba\u015far\u0131l\u0131 olanlar olarak vasfeder.9&nbsp;Do\u011fumunda sa\u011f kula\u011f\u0131na ezan, sol kula\u011f\u0131na k\u00e2met okunan \u015fah\u0131s, \u00f6l\u00fcm\u00fcnde cenaze namaz\u0131yla hayata veda etmektedir. \u015eahs\u0131n do\u011fumundaki bu seramoninin keyfiyeti, hatt\u00e2 ana rahmine&nbsp; d\u00fc\u015ft\u00fckten sonraki haklar\u0131, \u00f6l\u00fcm\u00fcnde yap\u0131lmas\u0131 gereken i\u015flemler, y\u0131kanmas\u0131, cenaze namaz\u0131 k\u0131l\u0131nmas\u0131, kefenlenmesi, kabre konulmas\u0131na de\u011fin f\u0131k\u0131h taraf\u0131ndan konu edinilerek derinlemesine i\u015flenmi\u015ftir.Allah ile kul aras\u0131ndaki ili\u015fkileri d\u00fczenlemekle i\u015fe ba\u015flayan f\u0131k\u0131h, namaz, oru\u00e7, zekat, hac, teh\u00e2ret (g\u00f6r\u00fcnen ve g\u00f6r\u00fcnmeyen pisliklerden temizlenme), s\u00fcnnet olma, yabanc\u0131 evlere girme us\u00fbl\u00fcne de\u011fin kurallar \u00f6ng\u00f6rm\u00fc\u015ft\u00fcr. B\u00f6ylesine&nbsp; detaya ait mevzulara ili\u015fkin olarak kurallar konulmas\u0131 daha ilk d\u00f6nemlerde bu duruma al\u0131\u015f\u0131k olmayan kimselerce dile getirilmi\u015ftir. Bu durumu yad\u0131rgayanlardan birisi Selman-\u0131 F\u00e2ris\u00ee\u2019ye \u015f\u00f6yle demi\u015ftir: \u201cAdam\u0131n\u0131z (Peygamber) size her \u015feyi, hatt\u00e2 nas\u0131l tuvalete \u00e7\u0131kaca\u011f\u0131n\u0131z\u0131 \u00f6\u011fretiyor.\u201d Bu hitaba muhatap olan F\u00e2ris\u00ee ise ona cevaben \u015f\u00f6yle demi\u015ftir: \u201cEvet, o bir kimsenin sa\u011f eliyle arkas\u0131n\u0131 temizlemesini, abdest bozarken k\u0131bleye d\u00f6nmesini, kuru tezek ve kemik kullanmas\u0131n\u0131 yasaklam\u0131\u015f, (su bulunmad\u0131\u011f\u0131nda veya yeterli olmad\u0131\u011f\u0131nda) kimse \u00fc\u00e7 ta\u015ftan daha az\u0131yla arkas\u0131n\u0131 temizlemesin buyurmu\u015ftur.\u201d10Sosyal hayata ili\u015fkin olarak fert-toplum, toplum-fert aras\u0131 ili\u015fkiler ve bu ili\u015fkilerin boyutlar\u0131, fert-devlet, devlet-fert aras\u0131ndaki hukuk\u00ee yap\u0131 ana hatlar\u0131yla Siyaset\u00fc\u2019\u015f-\u015eeriyye (Verwaltungsrect) ba\u015fl\u0131\u011f\u0131 alt\u0131nda derinlemesine i\u015flenmi\u015ftir. Devlet ba\u015fkan\u0131 olacak kimselerde aranacak vas\u0131flar, onlar\u0131n se\u00e7imi, y\u00f6neticilerin (ulu\u2019l-emr) emir sahibi ki\u015filer olarak nitelenmesi,11 onlar\u0131n verece\u011fi emirlere nereye kadar uyulaca\u011f\u0131 detayl\u0131 bir \u015fekilde yukar\u0131da zikredilen ba\u015fl\u0131k alt\u0131nda incelenmi\u015ftir. Yine devletler aras\u0131 hukuka ili\u015fkin olarak, devletler aras\u0131 ili\u015fkiler, sava\u015f ve bar\u0131\u015fa ili\u015fkin mevzular, sava\u015f sonras\u0131 elde edilecek ganimetlerin taksimi, sava\u015f esirlerinin hak ve hukukuna kadar insan\u0131 kucaklayan b\u00fct\u00fcn mevzularda, f\u0131k\u0131h g\u00f6r\u00fc\u015f\u00fcn\u00fc dile getirmi\u015f, tarih i\u00e7erisinde bu g\u00f6r\u00fc\u015fler uygulanarak pratize edilmi\u015f, halen de \u0130slam \u00fclkelerinin \u00e7o\u011funda&nbsp; muhtevalar\u0131 zaman ve mekan kavramlar\u0131 dikkate al\u0131n\u0131p zenginle\u015ftirilmek suretiyle pratize edilmekte ve uygulanmaktad\u0131r.\u0130ktisad\u00ee hayata ili\u015fkin olarak faizi yasaklamas\u0131, emek ve sermaye ikileminde kurulan sistemlerin ortas\u0131nda yer almas\u0131&nbsp; f\u0131kh\u0131n bu alandaki temel vasf\u0131d\u0131r. Hazine\u2019nin (beyt\u00fc\u2019l-m\u00e2l) olu\u015fumu, \u00f6\u015f\u00fcr ve cizye olarak zikredilen verginin tahsil edilmesine ili\u015fkin hususlar, toplumda ekonomik-sosyal dengenin kurulmas\u0131 amac\u0131na matuf olarak zenginlerin mallar\u0131ndan Kur\u2019an\u2019da zikredilen kimselere12&nbsp; verilmek \u00fczere tahsil edilen zek\u00e2t\u0131n b\u00fct\u00fcn boyutlar\u0131 f\u0131k\u0131h i\u00e7erisinde yerini alm\u0131\u015ft\u0131r. Bunlar\u0131n yan\u0131 s\u0131ra f\u0131k\u0131h, al\u0131m-sat\u0131m, kira, rehin, kredi, \u015firket gibi mal-\u015fah\u0131s aras\u0131nda olabilecek her t\u00fcrl\u00fc ak\u0131\u015fa y\u00f6n vermi\u015ftir.G\u00fc\u00e7l\u00fc toplum i\u00e7in g\u00fc\u00e7l\u00fc aileyi hedef edinmi\u015f, bunun ger\u00e7ekle\u015ftirilmesi i\u00e7in de evlilik ba\u011f\u0131n\u0131n kurulmas\u0131n\u0131 \u015fiddetle tavsiye ederek,13 zinay\u0131 yasaklam\u0131\u015ft\u0131r.14 Aile hayat\u0131na ili\u015fkin aile bireyleri aras\u0131ndaki hak ve \u00f6devleri \u00e7izmi\u015f, evlenen kad\u0131na mihir hakk\u0131 tan\u0131m\u0131\u015f,15 cinsel ya\u015fam\u0131n&nbsp; boyutlar\u0131na ili\u015fkin olarak&nbsp; kurallar koymu\u015ftur.16 F\u0131k\u0131h evlenme akdinin \u015fartlar\u0131n\u0131, birbirleriyle&nbsp; evlenmeleri caiz olan kimselerin durumlar\u0131n\u0131 izah ederek, 17 do\u011facak \u00e7ocuklar\u0131n hak ve hukuklar\u0131na ili\u015fkin kurallar getirmi\u015ftir. Evlenmeye g\u00fcc\u00fc yetmeyen fakirlerin evlendirilmesi hususunda toplumu sorumlu k\u0131lm\u0131\u015ft\u0131r.18 Evlilik akdinin \u015fartlar\u0131n\u0131 \u00e7e\u015fitli sebeblerle yerine getiremeyen bireylere bo\u015fanma hakk\u0131n\u0131 tan\u0131m\u0131\u015ft\u0131r. Zina su\u00e7unu i\u015fleyenleri k\u0131namakla beraber onlara cayd\u0131r\u0131c\u0131 cezalar \u00f6ng\u00f6rm\u00fc\u015ft\u00fcr.19B\u00fct\u00fcn bu ifadelerden de anla\u015f\u0131laca\u011f\u0131 \u00fczere f\u0131k\u0131h, ya\u015fam\u0131n b\u00fct\u00fcn alan\u0131n\u0131, bug\u00fcnk\u00fc insanl\u0131\u011f\u0131n anlad\u0131\u011f\u0131 hukuk kavram\u0131n\u0131n \u00e7ok \u00f6tesinde, geni\u015f bir \u015fekilde ku\u015fatmaktad\u0131r. \u0130nsan\u0131n her yapt\u0131\u011f\u0131n\u0131 bilen ve onu en b\u00fcy\u00fck mahkemede yarg\u0131layacak Allah, bizzat Kur\u2019an\u2019\u0131n ifadesiyle hakimlerin hakimidir.20 Yine Kur\u2019an\u2019a g\u00f6re, insan\u0131n gizli ve a\u00e7\u0131k olarak yapt\u0131\u011f\u0131 her \u015feyi bilen Allah21 Peygamber\u2019le il\u00e2h\u00ee mesaj\u0131 (Kur\u2019an) uyulmas\u0131 amac\u0131yla g\u00f6ndermi\u015ftir. Bu mesaj, bizzat (\u00fcsve-i hasene) olarak t\u00e2rif edilen22 Peygamber taraf\u0131ndan ya\u015fan\u0131larak insanl\u0131\u011fa g\u00f6sterilmi\u015ftir. Kur\u2019an bu a\u015famada Peygamber ba\u011fl\u0131lar\u0131ndan kutsal el\u00e7inin verdi\u011fini almay\u0131, sak\u0131nd\u0131rd\u0131klar\u0131ndan da ka\u00e7\u0131nmay\u0131 \u00f6\u011f\u00fctleyerek23 Peygamber\u2019e olan itaat\u0131 Allah\u2019a yap\u0131lan itaat olarak kabul eder.24 \u0130slam Hukuku\u2019nun kapsam\u0131n\u0131n di\u011fer hukuklardan mukayese edilemeyecek derecede geni\u015f olmas\u0131n\u0131n alt\u0131nda yatan temel sebep, temel kaynak olarak vahyin se\u00e7ilmesindedir.Sahas\u0131 ve etkileri hususunda ne d\u00fc\u015f\u00fcn\u00fcl\u00fcrse d\u00fc\u015f\u00fcn\u00fcls\u00fcn, do\u011fu\u015fundan bu \u00e2na kadar, \u0130slam co\u011frafyas\u0131na genel olarak bakt\u0131\u011f\u0131m\u0131zda f\u0131k\u0131h, ya\u015fayan etkin bir hukuk sistemidir. Baz\u0131 \u0130slam \u00fclkelerinden huk\u00fbk\u00ee hayat, uygulamalardaki farkl\u0131l\u0131klara ra\u011fmen tamamen f\u0131kha dayanmaktad\u0131r. \u00d6rf-adet, b\u00f6lge farkl\u0131l\u0131\u011f\u0131, \u00fclkelerin i\u00e7erisinde bulundu\u011fu \u00f6zel \u015fartlar ve kaynaklar\u0131n yorumlanmas\u0131 hususunda izlenen de\u011fi\u015fik us\u00fcller uygulamadaki farkl\u0131l\u0131\u011f\u0131 do\u011furan ana sebeblerdir. Suudi Arabistan, \u0130ran, Sudan, Afganistan, Yemen, Umman, Birle\u015fik Arap Emirlikleri, Katar bu \u00fclkeler grubuna \u00f6rnek olarak g\u00f6sterilebilir. Di\u011fer bir grup \u0130slam \u00fclkelerinde ise f\u0131k\u0131h, hukukun belli alanlar\u0131nda (ahval\u00fc\u2019\u015f-\u015fahsiyye, aile, miras, vak\u0131flar) uygulanmaktad\u0131r. Di\u011fer alanlarda ise bat\u0131 kaynakl\u0131 kanunlar y\u00fcr\u00fcrl\u00fc\u011fe konulmu\u015ftur. Bu \u00fclkelerde y\u00fcr\u00fcrl\u00fc\u011fe konulan bat\u0131 hukuku, daha ziy\u00e2de Frans\u0131z ve \u0130ngiliz hukuk sistemine dayanmaktad\u0131r. Hindistan, Malezya, Bengal ve Kuzey Nijerya\u2019da Comman Law, Afrika\u2019n\u0131n kuzeyindeki Frans\u0131z dili konu\u015fulan \u00fclkelerde Frans\u0131z hukuku, Endonezya\u2019da Hollanda hukuku iktibas kayna\u011f\u0131 olmaktad\u0131r. M\u0131s\u0131r, Irak, Suriye ve 1970 \u00f6ncesi Sudan\u2019da iktibas edilen hukuklar siyasi ve ideolojik ili\u015fkilere g\u00f6re de\u011fi\u015fmi\u015f, daha ziy\u00e2de Frans\u0131z, bazen \u0130ngiliz ve Sovyet hukukunun etkisi alt\u0131nda kalm\u0131\u015ft\u0131r.T\u00fcrkiye, Cumhuriyet d\u00f6neminde laiklik ilkesini kabul etmek suretiyle din ile hukuk aras\u0131ndaki ba\u011f\u0131 kopararak, hukuk kurallar\u0131n\u0131n dine dayal\u0131 olmayaca\u011f\u0131 prensibini hukukta temel ilke olarak kabul etmi\u015ftir. Cumhuriyet sonras\u0131 \u00e7\u0131kar\u0131lan anayasalarda devletin dini \u0130slam\u2019d\u0131r t\u00e2biri kullan\u0131lm\u0131\u015f, daha sonra 1982\u2019de \u00e7\u0131kar\u0131lan anayasada ise \u201claik devlet\u201d tan\u0131mlamas\u0131 yap\u0131larak, \u201cdevletin dini \u0130slam\u2019d\u0131r\u201d t\u00e2biri anayasadan \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.Halk\u0131 m\u00fcsl\u00fcman olan di\u011fer \u0130slam \u00fclkelerin \u00e7o\u011fu anayasalar\u0131nda ve kanunlar\u0131nda \u0130slam\u2019a ba\u011fl\u0131l\u0131klar\u0131n\u0131 dile getirmektedirler. Devletin \u0130sl\u00e2m\u00ee ilkelere ba\u011fl\u0131l\u0131\u011f\u0131 Fas, Tunus, Moritanya, Yemen, \u0130ran, Sudan, Afganistan, Pakistan anayasalar\u0131nda a\u00e7\u0131klanmaktad\u0131r. M\u0131s\u0131r (1948), Suriye 1949), Irak (1951) meden\u00ee kanunlar\u0131, hakimlere bo\u015fluklar\u0131 \u0130sl\u00e2m\u00ee esaslara g\u00f6re doldurma talimat\u0131n\u0131 vermektedir.
